This matter is taken up through Hybrid Arrangement Order No.

(Virtual/Physical Mode).

None appears for the Petitioner when the matter is called. Heard learned counsel for the State. Perused the Original Application along with its annexures.

The present writ petition has been filed by the Petitioner with a prayer to quash the Annexure-7. It is further prayed that a direction may be issued to the Opposite Parties to consider the claim of the Petitioner for availing 2nd ACP as on 1.1.2006 and any other reliefs which the Petitioner is entitled for. 4.

Learned counsel for the State submits that the dispute involved in the present writ petition is with regard to 2nd ACP after receipt of 1st RACP.

Considering the averments made and as the matter is of the year 2013, this Court finds no useful purpose would be served in keeping the matter pending. Accordingly, this Court disposes of the writ petition with a direction to the Petitioner to file a fresh representation before the Regional Chief Conservator of Forests, Bhubaneswar Circle, Bhubaneswar, Opposite Party No.3, taking all the grounds available to him in law along with the supporting documents and certified copy of this order within a period of two weeks. In such event, the Opposite Party No.3 shall consider and dispose of the same in accordance with law by passing a speaking and reasoned order within a period of three months from the date of production of certified copy of this order. Decision so taken shall be communicated to the Petitioner within ten days thereafter. It is made clear that this Court has not expressed any opinion on the merits of the case.

With the above direction, the writ petition stands disposed of.
