This matter is taken up through Hybrid Arrangement (Virtual/Physical Mode).

None appears for the Petitioner when the matter is called. Heard learned Additional Standing Counsel for State. 3.

Mr.Das, learned State Counsel submits that the present writ petition has been filed by the Petitioner challenging the action of the Opposite Party No.3 in issuing Advertisement dated 18.01.2013 under Annexure-7. Petitioner has further prayed for direction to the Opposite Parties to provide suitable number of posts in the cadre of Asst. Town Planner under the promotional quota as per Rule 11(iv) of the Orissa Town Planning Service Rules, 1970 and to convene the DPC to fill up the post of Asst. Town Planner on promotion as per the letter dated 19.10.2012.

On examination of the Petition, it is found that the age of the Petitioner at the time of filing the Original Application in the year 2013 was 54 years. So it is presumed that the Petitioner must have

// 2 // been retired from service on attaining the age of superannuation. Therefore, no effective relief can be granted to the Petitioner at this stage.

In such view of the matter, the writ petition stands disposed of as infructuous.
