RJ The writ petition has been registered before this Court on 10th August, 2021, after the original application was transferred from the learned Orissa Administrative Tribunal, Cuttack Bench, Cuttack upon its abolition. On perusal of the available order sheets of the learned Tribunal, it is indicated that the matter was never taken up after 03.03.2017.
It is submitted by the learned counsel for the petitioner that after unfortunate demise of the learned counsel who was engaged earlier, she has instruction to appear. It is further submitted that though the matter is pending since 2013 no counter affidavit has been filed before the learned Tribunal on behalf of the State. It is further submitted that she has no up-to-date instruction from the petitioner, at present to pursue the litigation. Learned counsel for the petitioner submits that the petitioner may be permitted to withdraw the writ petition to pursue the remedy, if any, available under law before
// 2 // the appropriate authority/forum.
Learned Standing Counsel submits that any representation that would be made before the appropriate authority shall be considered in accordance with law in its own merit and disposed of in due time.
Having heard learned counsel for the parties, the writ petition is disposed of as not pressed granting liberty to the petitioner to seek remedy, if any, as available under law.
