This matter is taken up through hybrid mode.
The writ petition has been renumbered and registered before this Court on 10.08.2021 after being transferred, upon abolition of Odisha Administrative Tribunal, Cuttack. 2.
On perusal of the available order-sheet of the learned Tribunal, it is found that the matter was never taken up after 28.01.2019.
From the perusal of the order-sheet of the learned Tribunal, it is also indicated that on 10.08.2013, the matter was taken up another O.A. No.1395 of 2013 and orders were passed only in the said O.A. No.1395 of 2013. The said other O.A. is not listed today.

It is submitted by the learned counsel for the petitioner that he is the counsel engaged in the other original application and has no up-to-date instruction in either of the Original Applications, i.e., O.A. No.1395 of 2013 or the present O.A. to pursue the litigation. It is further submitted that the applicant in the writ petition could not be contacted to enquire about
// 2 // the present status of this service as he is not in touch with the learned counsel.

The original application was filed before the leaned Tribunal challenging the order of suspension dated 17.12.2012 issued by opposite party no.2-Collector-Kendrapara suspending the applicant/petitioner while he was working as Executive Officer/VLW in Derabis Block, Dist -Kendrapara. It is submitted by the learned Addl. Government Advocate that in view of the long lapse of time of about nine years, nothing would survive for determination in the present writ petition.

Having heard the learned counsel for the parties, the writ petition is disposed of as not pressed granting liberty to the petitioner to revive the same within sixty days for any surviving cause of action.
