Heard learned counsel for the parties.

The petitioner has filed this writ petition seeking to quash the order of dated 04.10.2021 passed by the District Education Officer, Bhadrak under Annexure-18, which has been passed in compliance to the order dated 21.01.2021 passed in WPC (PIL) No. 17293 of 2020, whereby the petitioner has been disengaged from service, i.e. Contract Teacher (TI) A.B. High School, Basudevpur.

Mr. S. Jena, learned Standing counsel for School & Mass Education Department contended that the order impugned is appealable one under OCS (CCA) Rules, 1962 and instead of preferring appeal, the petitioner has approached this Court in the present writ petition. 5.
Mr. K. Swain, learned counsel for the petitioner contended that the petitioner may be permitted to withdraw the writ petition with liberty to approach the appellate authority.

In view of the above, this writ petition stands disposed of permitting the petitioner to approach the appellate authority as per the rules, if he is so advised.
