Mr. K.C. Sahu, learned counsel appearing for the Petitioner submits that the Petitioner/Applicant filed the Original Application before the Odisha Administrative Tribunal being aggrieved by the decision in the DPC held in 2009, whereby she was not given promotion as vigilance case bearing T.R. No. 67 of 2006 was pending in the court of learned Special Judge (Vigilance), Bhubaneswar.

Learned counsel for the Petitioner/Applicant submits that the Petitioner during pendency of the O.A. and the writ petition, she got retired on attaining age of superannuation. Hence, no cause of action survives.
