This matter is taken up through virtual/physical mode. 2.

The Original Application No.2956 of 2016 was filed before the Odisha Administrative Tribunal, Bhubaneswar. After its abolition, the same has been transferred to this Court which is renumbered as WPC (OA) No.2956 of 2016.

The Petitioner, Senior Lecturer in Electronics, working as Principal-in-Charge of Government Polytechnic, Malkanagiri on deployment under Directorate of Technical Education and Training, Odisha, Cuttack considering himself eligible for promotion to the rank of Senior Lecturer from the date his junior Sri P.R. Mohanty promoted to the rank of Senior Lecturer on 20th February, 1999, filed the Original Application before the Odisha Administrative Tribunal, which is later on converted to writ petition being transferred to this Court and submitted that the representation of the Petitioner being forwarded to the Government in Industries Department by Director of Technical Education, Odisha with a recommendation of stepping up of pay of the Petitioner vide letter dated 7th August, 2008 is under consideration. 3.

The order sheets maintained by the Odisha Administrative Tribunal vide order dated 2nd January, 2016 reveals that while issuing notice, the said Tribunal observed that pendency of the

// 2 // Original Application would not be a bar for consideration of the representation of the Petitioner dated 19th August, 2016 vide Annexure-9.

None appears for the Petitioner at the time of call. 5.

Mr. P.K. Mohanty, learned Additional Standing Counsel submitted that the matter has been rendered infructuous due to efflux of time. The representation as per interim order of the said Tribunal ought to have been considered by now. 6.

With the aforesaid submission, the writ petition stands disposed of as infructuous.
