This matter is taken up through Hybrid Arrangement Order No.

(Virtual/Physical Mode).

None appears for the Petitioner when the matter is called. Heard learned Standing Counsel for School and Mass Education Department.

The present writ petition has been filed by the Petitioner with a prayer to quash the gradation list under Annexure-3 and further pray for a direction to the Opposite Parties to prepare the fresh gradation list as per the Orissa Elementary Education Rules, 1997 and Amendment Rule, 2009 and for a direction to give promotion as per the said list.

Considering the fact that the Original Application has been filed in the year 2013 challenging the gradation list of the year 2012, learned Standing Counsel for School and Mass Education

// 2 // Department submitted that the Petitioner's grievance must have been redressed in the meantime. It is further submitted that if the grievance of the Petitioner has not been redressed till date, Petitioner is at liberty to approach the Authority by filing a fresh representation taking all the grounds available to him in law. In such event, the Opposite Party No.1 shall consider the same in accordance with law within a stipulated period of time.

In view of the above, this Court feels it appropriate to direct the Petitioner to file a fresh representation before the Opposite Party No.1 taking all the grounds available to him in law along with the supporting documents and certified copy of this order. In such event, the Opposite Party No.1 shall consider the same in accordance with law by passing a speaking and reasoned order. Decision so taken shall be communicated to the Petitioner within two weeks thereafter. 6.

With the above direction, the writ petition stands disposed of.
