1. This matter is taken up through hybrid mode. The writ petition has been renumbered and registered before this Court on 06.08.2021 after being transferred, upon abolition of Odisha Administrative Tribunal, Bhubaneswar. On perusal of the available order-sheet of the learned Tribunal, it is found that the matter was never taken up after 07.02.2012.

The original application was filed before the learned Tribunal by the petitioner, who is in the category of P.W.D. (visually impaired), inter alia, seeking a direction to get appointment, as Junior Clerk in the establishment of Nabarangpur Collectorate on the ground that the person selected opposite party no.2, belonging to the category of SEBC, was blind by 40% whereas the petitioner was blind by 65%. It is submitted by the learned counsel for the petitioner that the petitioner being more handicapped in comparison to the selected candidate should have been given appointment. It is submitted by the learned Additional Government Advocate on the other hand, referring to the counter affidavit that

// 2 // the selected candidate secured 238 marks in the written test, 23 marks in the computer skill test, whereas the petitioner secured 182.5 marks in the written test and 34 marks in the computer skill test.

Learned counsel for the petitioner fairly submits that in view of the performance in the selection test, the opposite party securing more marks is not disputed.

In view of the above, the writ petition is dismissed, being devoid of any merit.
