1. Learned counsel for the State submits that no F.I.R. has yet been registered involving the present Petitioners.

2. It is submitted by the learned counsel for the Petitioner that in view of the nature of allegations it was incumbent upon the investigating agency to resort to the provision of Section 41-A, Cr.P.C., which apparently has not been resorted to.

3. In such view of the matter, the Petitioner is permitted to withdraw this bail application with liberty to file application in case his name appears in the charge-sheet or otherwise if any fresh cause of action arises.

4. The ABLAPL is disposed of accordingly.
