This matter is taken up through hybrid mode.
2. Heard learned counsel for the petitioner.
3. The petitioner has filed this writ petition seeking to quash the principle (2) mentioned in the order/letter dated 09.11.2011 adopted by the Department for preparation of the Gradation List and pass appropriate consequential order to incorporate the names of officer retired/dead in the Revised/Final gradation List made pursuant to Annexure-3. He further seeks direction to the opposite parties to restore and fix his inter se seniority under Rule 20 of 1980 Rules and extend the benefit of further promotion and other consequential service benefits including the financial ones and re-fixation of pension and pensionary dues accordingly resulting from re-fixation of inter-se-seniority within a specific time period.
4. In course of hearing, learned counsel for the
petitioner states that highlighting the grievances, the petitioner has made representation to opposite party no.1 vide Annexure-4 and the same may be directed to be considered within a stipulated time, to which learned State Counsel has no objection.
5. As agreed by the learned counsel for the parties, this Court, without expressing any opinion on the merits of the case, disposes of the writ petition directing opposite party no.1 to consider the representation filed by the petitioner vide Annexure-4 and pass appropriate order in accordance with law within a period of three months from the date of production of certified copy this order.
