Heard Mr. L.K. Mohanty, learned counsel for the Petitioner and Mr. N. Prusty, learned Standing Counsel for the State.

Pursuant to the last order passed by this Court an Addl. Affidavit has been filed by the District Education Officer, Boudh - Opposite Party No.3 and the said officer is also present in Court today.

The Addl. Affidavit filed by the District Education Officer, Boudh - Opposite Party No.3 in Court today be kept on record.

It is stated in the said affidavit that the post as against which the Petitioner was selected is still vacant and there is no objection if the Petitioner will join in the said post.

In view of the said stand taken by the D.E.O., Boudh, in Paragraph-5 of the Addl. Affidavit, this Court while disposing the Writ Petition directs the Principal Adarsha Vidyalaya, Kantamal to accept the joining of the petitioner which has already been submitted after his selection and allow the petitioner to discharge his duty. Opposite Party No.4 is directed to act on the production of the copy of the order by the Petitioner.

The Writ Petition is disposed of accordingly. The personal appearance of District Education Officer, Boudh - Opposite Party No.3 is dispensed with.
