The Original Application No. 851 of 2012 was filed before the State Administrative Tribunal, Bhubaneswar. After its abolition, the same has been transferred to this Court which is renumbered as WPC (OA) No. 851 of 2012.

The Petitioner, working as Junior Clerk in the Government Science College, Chhatrapur, prayed for direction to the Director, Higher Education, Odisha (Opposite Party No.2) for consideration of his case for promotion to the post of Senior Clerk from the date his immediate JuniorOpposite Party No.4, namely, Krushna Chandra Sethy, was promoted and he also sought to be posted at the same station he has been working.

On the last occasion, when the matter was on board i.e., 3rd March, 2022, none appeared for the Petitioner. Today also none appeared. Therefore, it is construed that the Petitioner is no more interested in pursuing his matter.

Mr. P.K. Mohanty, Additional Standing Counsel submitted that the petitioner has disclosed his age in the cause title of the Original Application as 52 years on the date of filing of said application i.e., in the year 2012. He, therefore, submitted that the Petitioner would have been retired by now and by efflux of time, the matter has been rendered infructuous.

In view of the aforesaid submission, the writ petition is dismissed as infructuous.
