RJ The writ petition has been registered before this Court on 10th August, 2021, after the original application was transferred from the learned State Administrative Tribunal, Principal Bench, Bhubaneswar upon its abolition.
On perusal of the available order sheets of the learned Tribunal, it is indicated that the matter was never taken up after 02.01.2017.
The original application was filed in the year 2013 before the learned Tribunal, Principal Bench, Bhubaneswar by the applicant, who was 52 years of age working as Inspector of Police, Special Branch, Bhubaneswar challenging the initiation of the departmental proceeding and issuance of charge memo dated 12.09.2012 (Annexure-4) issued by the Director General of Police & Inspector General of Police, Odisha, Cuttack (opposite party no.2).
Learned counsel for the petitioner submits that he
// 2 // has no up-to-date instruction to pursue the matter at present.
Learned Standing Counsel submits that after long lapse of time, nothing survives for adjudication in the present writ petition and the initiation of the departmental proceeding is in accordance with the relevant service rules and there cannot be faulted with and no cause of action would survive as the petitioner would have retired in the year 2021.
Having heard learned counsel for the parties, the writ petition is disposed of as not pressed granting liberty to the petitioner to revive the same within sixty days for any subsisting cause of action.
