Heard the learned counsel for the Petitioner and learned counsel for the State.

The Petitioner has filed the present Writ Petition for the following relief:- "i) The applicant prays that This Hon'ble Tribunal would be graciously pleased to admit this original application and after hearing direct the respondent No.2 to release the full pensionary benefits gratuity etc. with interest fixed by this Hon'ble Tribunal, within the a specified period and to dispose of the representation dated 25.04.2011 and 07.01.2012 under Annexure-5 Series.

And further be pleased to pass such other order or orders deem (s) proper in the interest of justice, so as to give complete relief to the applicant".

In course of hearing, it is submitted by the learned counsel for the Petitioner that for the self-same relief, he has approached the opposite party No.1 vide Annexure-5

// 2 // on 07.01.2012. He also further submitted that no decision has been taken on such prayer of the Petitioner till date. Taking into account the pendency of the same before the opposite party No.1, the opposite party No.1 is directed to take a decision on the claim of the Petitioner made under Annexure-5 within a period of three months from the date of communication of the order on its own merit. The Opposite Party No.1 is also further directed to communicate the order to the Petitioner thereafter. 5.

With the aforesaid observation and direction, the Writ Petition (OAS) stands disposed of.
