This matter is taken up through Hybrid arrangement (video conferencing/physical mode). Heard learned counsel for the petitioner and learned counsel for the State.

This Writ Petition has been filed by the petitioner Kalpana Pradhan challenging the order dated 27.10.2022 passed by the Sub-Collector, Deogarh (opposite party no.2) holding that her appointment in AWC-A of village Aunli was not done in a fair manner and direction was given to cancel her appointment as Anganwadi helper and appoint someone afresh with

// 2 // due procedure.

The learned counsel for the State drew attention of this Court to the clarification on selection/engagement/re-engagement of Anganwadi worker/Anganwadi helper dated 06.09.2006 issued by the Women and Child Development Department, from which it appears that an appeal can be filed against the order passed by the Collector before the Director, S.W. and if the appeal is not filed within two months from the date of issue of disengagement order then the selection process will be started from the beginning of the 3rd month.

In view of such provision, when a query was made to the learned counsel for the petitioner as to whether pursuant to Annexure-7, any disengagement order has been issued in respect of the petitioner, the answer is in negative.

Therefore, since the disengagement order has not yet been issued and more particularly when there is an appeal provision against such disengagement order, this writ petition is pre-mature and accordingly disposed of.
