Heard learned counsel for the Petitioner and learned counsel for the State.

The Petitioner is the accused in connection with C.T. Case No.523 of 2022, pending on the file of learned S.D.J.M., Balasore, arising out of Balasore Town P.S. Case No.130 of 2022 for the alleged commission of offence under Sections 395/398 IPC and Section 27 of the N.D.P.S Act.

Being aggrieved by the rejection of his application for bail U/s. 439 Cr.P.C. by the learned Sessions Judge, Balasore by order dated 11.07.2022, the present BLAPL has been filed. 4.

It is submitted by the learned counsel that the Petitioner is in custody since 23.06.2022 and as charge sheet has been filed in the meanwhile, his further continuance in custody is not warranted. 5.

Learned counsel for the State opposes the prayer for bail on the ground that the Petitioner has been identified in the T.I parade and he has criminal antecedent of similar nature.

Taking into account that the Petitioner has been identified in the T.I parade and has criminal antecedent of similar nature, this Court is not inclined to release the Petitioner on bail at this stage. 7.

Accordingly, BLAPL stands rejected. Liberty is given to the Petitioner to move afresh after commitment. (V. NARASINGH) Judge PKS
