Heard learned counsel for Petitioner and learned counsel for the State-Opposite Parties.

The present Writ Petition has been filed with the following prayer:- "(i) Quash the principle (2) in the impugned order at Annexure-3 adopted by the Department for preparation of the Gradation list and to pass appropriate consequential order to incorporate the names of office retired / dead in the Revised / Final Gradation List made pursuant to Annexure-3.
(ii) Direct the Respondents to restore and fix the inter-se-seniority of the applicant under Rule 20 of 1980 Rules.
(iii) To extend the benefit of further promotion(s) and other consequential service benefits including the financial ones and re-fixation of pension and pensionary dues accordingly resulting from re-fixation of inter-se-seniority within a specific time period.
(iv) Pass any other order(s) and / or direction(s) as may be deemed fit and proper in the interest of applicant for the interest of justice and for this act of kindness, the applicant as in duty bound shall remain pray".

Learned counsel for the Petitioner submits that through highlighting his grievances, the Petitioner has filed a representation on 27.08.2012 at Annexure-4 to the Writ Petition, before the opposite party No.1 but till date nothing has been done in the matter. In such background, he prays that a direction be issued to opposite party No.1 to take a decision on the above noted petition within a specific time period.

Considering the submissions made and without expressing any opinion on the merits of the case, this Court directs opposite party No.1 to take a decision on the above noted petition in accordance with law and also taking into account the order passed under Annexure-2 within a period of three months from the date of production of certified copy of this order and communicate the result of such exercise to the petitioner.
6. With the aforesaid observation and direction, the Writ Petition is disposed of.
