This matter is taken up through virtual/physical mode. 2.
The Original Application No.4535 (C) of 2014 was filed before the Orissa Administrative Tribunal, Cuttack Bench, Cuttack. After its abolition, the same has been transferred to this Court which is renumbered as WPC (OAC) No. 4535 of 2014.

The grievance of the Petitioner is that through he is senior to Opposite Party Nos.6 and 7, he was not given promotion to the post of Junior Clerk under the work charged establishment of R.W.S. & S Circle, Bhubaneswar. 4.
The Petitioner prayed for the following reliefs: "xx xx xx xx II) The Hon'ble Tribunal after perusing the show cause and after hearing the parties from both sides be pleased to quash the order dated 5.7.2013 (Annexure-8 series) relating to regularization of services of Respondent No.6 and 7 as Junior clerk under work charge establishment under Respondent No.4:
III) Direct Respondent No.3 and 4 to regularizing the service of the present applicant in the work charge establishment of Junior clerk in a vacant post under Respondent No.4.

Mr. Anupam Rath, learned Additional Standing Counsel for the State submits that the counter has been filed by Opposite Parties, wherein it has been demonstrated that the Petitioner is not eligible to be regularized in the said post. He pointed out that Opposite Party No.4, namely, Superintending Engineer, R.W.S. & S Circle, Bhubaneswar after cancellation of provisional common gradation list and in accordance with the approved list of N.M.R. employees as communicated by Opposite Party No.3, namely, Chief Engineer of R.W.S & S., Government of Odisha, Bhubaneswar has regularized the services of Opposite Party Nos.6 and 7.

By efflux of time, the matters seems to have been rendered infructuous.

Accordingly, this writ petition is disposed of as infructuous with liberty to the Petitioner to revive this petition within ninety days from today, if any cause of action still subsists.
Issue urgent certified copy as per rules.
