1. Heard learned counsel for the Petitioner and the State.
2. This is an application for bail U/s.438 Cr.P.C. filed by the Petitioner in anticipation of arrest for his alleged involvement in the offences U/s.323/294/420/379/506/34 IPC.
3. Learned counsel for the Petitioner submits that the present case is one arising out of business transaction between the parties and there is a dishonoured of cheque as submitted under Annexure-2.
4. Keeping in view the submission of the parties and having gone through the nature of allegations as emerged from the material on record and further the circumstances appearing, the seriousness and gravity of the offences, it is directed that in the event the Petitioner surrenders in connection with Khandagiri P.S. Case No.521 of 2022 corresponding to C.T. Case No.5568 of 2022 pending in the court
// 2 // of learned S.D.J.M., Bhubaneswar within a period of two weeks' hence and moves for bail, he shall be released on such terms and conditions as would be deemed just and proper by the said court with further conditions that he shall appear in person before the court below on each date of posting of the case unless specifically exempted by the court concerned and shall appear before the IO/IIC of the concerned PS once in a week on such date and time fixed by the IO/IIC for a period of six months or till the submission of Final Form as the case may be with the further condition that he shall not terrorise or indulge the informant party. Violation of any of the conditions shall entail cancellation of bail of the Petitioner.
5. The ABLAPL is disposed of.
