2. It is submitted that no memo as such has been filed by the engaged counsel to withdraw the same. Hence, the memo at Flag-A for withdrawal of the Writ Petition is not entertained. (Biraja Prasanna Satapathy) Judge WPC (OAC ) No.2657 of 2014 4.

1. Heard learned counsel for the petitioner and Mr. Mohanty, learned A.G.A

2. This Writ Petition has been filed with the following prayer. (a) Admit the Original Application, call for the record, hear the parties and quash the orders/letters dated 19.8.2014 under Annexure-9 series and direct the respondents to allow the applicant to continue as a Primary School Teacher as before and no fresh selection be made in respect of the post held by the applicant.

3. It is submitted that some of the petitioners in the meantime were regularized in the year 1997 vide order dated 12.1.2021, but the petitioners have not been extended with such benefits.

4. In view of such submission, liberty is granted to the petitioners to file individual representation before District

// 2 // Education Officer, Sambalpur-Opp. Party No.3 ventilating their grievances within a period of three weeks from today.

5. It is observed that if any such application is filed, Opp. party No.3 shall take a lawful decision on the same within a period of three (Three) months from the date of receipt of such representation. It is observed that while taking such a decision, the stand taken by the petitioners that similarly situated persons have been extended with the benefit w.e.f 1.9.1997 vide order dated 12.1.2021 be taken into consideration.
