1. This matter is taken up through hybrid mode. Order No.

2. Heard learned counsel for the Petitioner and learned Addl. Standing Counsel for the State.

3. As directed, the Superintendent of Police, Kandhamal has submitted a report on the medical documents enclosed to I.A. No.425/22, which has since been not pressed by the Petitioner. The report of the S.P. reveals that on an inquiry being conducted by I.I.C. of Phiringia Police Station, it was ascertained that the Medical documents in support of the treatment of the wife of the Petitioner (Manoj Kumar Pradhan)

// 2 // are fake ones. The OPD prescription, OPD ticket, the official seal and signature of the Medical Officer on the Medical Certificate etc. are all fakes. It is, however, not indicated as to who is responsible for creating such fake documents.

Mr. P.K.Sejapada, learned counsel appearing for the Petitioner, submits that he had received the documents from the family of the Petitioner and had submitted them along with the I.A. before this Court bonafide and on good faith thinking them to be genuine. Mr. Sejapada further expresses his apology for the inconvenience caused and prays for permission to withdraw the bail application.

5. Having considered the report of the S.P., Kandhamal, this Court is of the view that further inquiry is required to find out the culprit responsible for creating the fake documents. The S.P., Kandhamal is, therefore, directed to conduct necessary inquiry in this respect and to take action against the culprit/culprits in accordance with law.

6. Having regard to the prayer made by learned counsel for the Petitioner, the bail application is dismissed as withdrawn. Sashikanta Mishra) AKB Judge
