1. Heard learned counsel for the Petitioner and the State.

2. By means of this application, the Petitioner seeks grant of bail U/s.438 Cr.P.C. in apprehension of arrest for his alleged involvement in the offences U/s. 147/148/452/341/323/294/395/ 427/506/149, I.P.C. and Sections 25 & 27 of Arms Act, in connection with G.R. Case No.127 of 2022 arising out of Baideswar P.S. Case No.44 of 2022 pending in the court of learned S.D.J.M., Banki.

3. Learned counsel for the Petitioner submits that there are 27 accused persons arrayed in the present F.I.R. and out of them 26 accused persons have since been released on bail. The present Petitioner being arrayed at serial No.18 of the F.I.R, is also in similar footing with the aforesaid accused persons and therefore he prays that the present Petitioner may also be allowed to go on bail.

Keeping in view the above submissions, the nature of allegations, the circumstances appearing in the case and the seriousness and gravity of the offence, while this Court is not inclined to grant anticipatory bail, it is directed that, in the event the Petitioner surrenders and moves for bail before the learned S.D.J.M., Banki in the aforesaid G.R. Case within a period of three weeks hence, he shall be admitted to bail on such terms and conditions as would be deemed just and proper by the said court.

5. The ABLAPL is disposed of accordingly.
