Whatever grounds raised herein and urged in the course of Order No.

argument can very well be taken in the statutory remedy of appeal and the same can very well be considered by the appellate authority. This Court, therefore, finds no scope for entertaining the Writ Petition in avoidance of a clear statutory remedy of appeal available with the Petitioner.

In the circumstance, this Court declines to entertain the Writ Petition at this stage. The Writ Petition is, accordingly, dismissed. 3.

At this stage Mr. Purohit, learned counsel for Petitioner urges this Court for directing the appellate authority for at least considering the grounds raised in the writ petition. For there is no appeal filed as of now and as the Petitioner has sufficient scope to raise this issues in the

// 2 // memorandum of appeal, there is no scope for the High Court to give such observation.
