1. This matter is taken up by hybrid mode.

The Original Application having been transferred from the learned Orissa Administrative Tribunal, Bhubaneswar upon its abolition, has been registered before this Court on 11.8.2021.

2. On perusal of the available order sheets of the learned Tribunal it is indicated that the matter was never taken up after 12.3.2015.

3. The O.A. was filed before the learned Tribunal challenging the order of suspension dated 16.7.2013 (Annexure-8) with a further direction to consider the representations of the petitioner for revocation of suspension.

4. It is submitted by learned proxy counsel for the petitioner that they do not have up-to-date instruction to pursue the litigation at present.

5. It is submitted by learned Standing Counsel that considering the nature of grievance raised in the writ petition, nothing would survive after a long lapse of time of nine years.

4. Having heard learned counsel for the parties, the writ petition is disposed of as not pressed granting liberty to the petitioner to revive the same within sixty days for any surviving cause of action. (M.S.Sahoo) Judge dutta
