ORDER(Oral) 11.7.2022 02 1. This matter is taken up through hybrid mode.

2. When the matter was taken up on 29.4.2022, after considering it in some detail, the following order was passed : "2.

The writ petition has been renumbered and registered before this Court on 13.12.2021 after being transferred, upon abolition of Odisha Administrative Tribunal, Cuttack.

On perusal of the available order-sheets of the learned Tribunal, it is found that the O.A. was taken up and was adjourned on 22.09.2014 and none had appeared for the petitioner on 12.12.2014 and 16.11.2016 and 23.07.2018.

The Original Application was filed in the year 2014 by the petitioner working as Village Level Worker at K.Gumma Block, At/P.O.K.Gumma in the district of Malkangiri for disposal of the departmental proceeding initiated by letter no.1542 dated 02.09.2010 (Annexure-2) issued by the opposite party no.2Collector, Malkangiri. 5.

Learned Standing Counsel submits that the long pendency of the matter, has resulted in the matter becoming infructuous.

To grant another opportunity to the petitioner, list on 11.07.2022."

3. It is submitted by learned counsel for the petitioner that he has no instruction to pursue the matter at present on behalf of the petitioner.

4. Learned Standing Counsel reiterates his submissions on behalf of the O.Ps. as noted in the order dated 29.4.2022.

5. Having heard learned Standing Counsel for the parties, the writ petition is disposed of for lack of up-to-date instruction from the petitioner to pursue the matter at present granting liberty to revive the petition within sixty days for any surviving cause of action.
