Heard learned counsel for the Petitioner and learned counsel for the Opposite Parties.

The Petitioner has filed the present Writ Petition with the following prayer:- (i) Under the circumstances, it is humbly prayed that this Hon'ble Tribunal may be graciously pleased to direct the Respondents to grant the benefits of 2nd ACP in favour of the applicant with effect from 01.09.2008.

(ii) And further be pleased to direct to revise the pension of the petitioner by enhancing 50% of the minimum pay band plus Grade pay per month along with the TA as admissible for the full qualifying service.

(iii) And further be pleased to direct the Respondents to count the untrained service period from the initial date of appointment till 1980.

(iv) And / or Pass any other order / orders as this Hon'ble Tribunal deems fit and proper in this case".

Considering the submission made and without expressing any opinion on the merits of the case, the Petitioner is directed to make a fresh representation before the Opp. Party No.1 by

// 2 // enclosing all the relevant documents and citations in support of his claim, if any, within a period of three weeks hence. 5.

It is observed that if such a representation is filed within the aforesaid period, the Opp. Party No.1 shall do well to take a lawful decision within a period of three months from the date of receipt of such representation. The order so passed by the Opp. Party No.1 be communicated to the Petitioner. 6.

With the aforesaid observations and directions, the Writ Petition is disposed of.
