RJ This matter is taken up through hybrid mode.
The writ petition has been registered before this Court on 11th August, 2021, after the original application was transferred from the learned State Administrative Tribunal, Bhubaneswar upon its abolition.
On perusal of the available order sheets of the learned Tribunal, it is indicated that after notices were issued on 05.11.2015 the matter was listed on 22.02.2019 after the earlier date of listing: 10.12.2015 and on both the dates the matter was not taken up.
It is submitted by the learned counsel for the petitioner that the petitioner had annexed the representation dated 13.12.2012 in the original application marked as Annexure8 made to the Collector and District Magistrate, Mayurbhanj for redressal of his grievances and the long pendency of the original application has not helped in any manner. It is further submitted that the petitioner may be allowed to move the appropriate authority by making a representation afresh for redressal of his grievances and the
// 2 // same is to be considered by the authority in accordance with law.
Learned Addl. Standing Counsel in response submits that any representation that would be made shall be considered by the authority in accordance with law and shall be disposed of in due time.
Having heard learned counsel for the parties and considering the nature of grievances raised in the writ petition, the writ petition is disposed of with the following directions:- The petitioner, if so advised, shall make a representation afresh before the appropriate authority for redressal of his grievances enclosing the certified copy of this order along with all relevant documents sought to be relied upon by the petitioner.
The authority on receipt of such representation, shall do well to consider and dispose of the representation of the petitioner in accordance with law as expeditiously as possible, preferably within a period of four months from the date of receipt of the certified copy of this order along with copy of the representation(s) and all other documents sought to be relied upon by the petitioner.
The order that would be passed by the authority shall be communicated to the petitioner within two weeks. It is clarified that this Court has not expressed any opinion regarding merits of the case, in any manner whatsoever.
