2. The petitioner challenges the action of the opposite parties in not considering his case for promotion to the rank of Engineer In-chief, P.H. Department on the ground that the said action is illegal and arbitrary.

3. Learned counsel for the petitioner submits that since the petitioner has already been retired from service, hence no cause of action survives.

4. However, if any cause of action survives he may approach this Court afresh.
