IN THE HIGH COURT OF ORISSA AT CUTTACK

WPC(OAPC) No. 82 of 2014 Nrusingha Charan Swain ....

Petitioner Mr. Satyabrata Mohanty, Advocate -versusState of Odisha & others ....

Opp. Parties Mr. T.K. Praharaj, Standing Counsel

CORAM:

JUSTICE M.S. SAHOO Order No.

ORDER

07.04.2022 01.

1.

This matter is taken up through hybrid mode.

RJ 2.

The writ petition has been registered before this Court on 14th December, 2021, after the original application was transferred from the learned State Administrative Tribunal, Cuttack Bench, Cuttack upon its abolition.

3.

On perusal of the available order sheets of the learned Tribunal, it is indicated that the matter was not admitted by the learned Tribunal and was not taken up after 17.07.2014.

4. Learned counsel for the petitioner submits that he has no up-to-date instruction to pursue the litigation from the petitioner who had filed the O.A. in the year 2014. The applicant/petitioner was aged about 78 years, sought for a direction for engagement of his second son under Rehabilitation Assistance Scheme after death of his son Ashok Ku. Swain in a road accident in the year 2013 who was earlier engaged under Rehabilitation Assistance Scheme after the applicant had taken VRS.

5.

Learned Standing Counsel submits that considering

// 2 // the nature of grievance raised in the writ petition nothing would survive after a long lapse of time.

6.

Having heard learned counsel for the parties, the writ petition is disposed of for lack of up-to-date instruction from the petitioner granting liberty to revive the same within sixty days for any surviving cause of action. (M.S. Sahoo) Judge
