The Original Application No. 4061 of 2014 was filed before the State Administrative Tribunal, Cuttack Bench, Cuttack. After its abolition, the same has been transferred to this Court which is renumbered as WPC (OAC) No. 4061 of 2014.

The Petitioners have challenged the amendment carried out in the Odisha Elementary Education (Method of Recruitment and Conditions of Service of Teachers & Officers) Rules, 1997. Validity of Rule 9 of the Odisha Elementary Education (Method of Recruitment & Conditions of Service of Teachers and Officers) Amendment Rules, 2014 which Rule 11 of the aforesaid Rules, 1997 stood amended has been attacked as the same restricted the promotional revenue for C.T. Teachers.

Mr. Biswa Bihari Mohanty, Advocate for the IntervenorLakshmi Narayan Rout submitted that the said challenge of the Petitioners was not favoured with by the learned Odisha Administrative Tribunal, which was further confirmed by this Court.

He also submitted that further amendments are also carried out in the said rules at the later point of time, thereby rendering the present writ petition infructuous.

In view of such submission, there remains nothing to be decided in this writ petition. None appeared for the Petitioners at the time of call, indicates that the Petitioners are no more interested to pursue this matter.
