Heard learned counsel for the Petitioners and learned counsel for the State.

The Petitioners are accused in G.R Case No.1664 of 2022 pending on the file of learned S.D.J.M., Panposh, Rourkela, arising out of Chhend P.S Case No.191 of 2022, for commission of the offence alleged under Sections 419/ 420/ 294/ 506/ 465/ 468/ 471/472/120-B/34 IPC and Sections 66-C/66-D of the Information and Technology Act.

Being aggrieved by the rejection of their application for bail U/s.439 Cr.P.C. by the learned 2nd Addl. Sessions Judge, Rourkela by order dated 27.10.2022 in the aforementioned case, the present BLAPL has been filed.

Perused the order of rejection.

Learned counsel for the Petitioners submits that the Petitioners are in custody since 19.09.2022 and as charge sheet has
been filed on 11.11.2022, their further continuance in custody is not warranted. The charge sheet filed is taken on record. 6.
Keeping in view the nature of allegation that they duped the Informant a sum of Rs.4,999/- and that they are first offenders, as stated, this Court directs the Petitioners to be released on bail on such terms to be fixed by the Court in seisin over the matter. 7.
While releasing on bail, learned Court in seisin shall verify the criminal antecedent of similar nature. If the Petitioners have such criminal antecedent, this order shall stand recalled without further reference to the Bench.

The BLAPL thus stands disposed of.
