1. 1. This matter is taken up through hybrid mode.

2. The writ petition has been registered before this Court on 03.08.2021 after the Original Application was transferred from the learned Odisha Administrative Tribunal, Cuttack Bench, Cuttack upon abolition.

3. On perusal of the available order-sheets of the learned Tribunal, it is indicated that the writ petition, W.P.(C) No.4016 of 2013 was transferred to the learned Tribunal by order of this Court dated 19.07.2017 and thereafter after upon abolition of the learned Tribunal has been again transferred to this Court during pendency of the petition for more than nine years, it was never admitted nor notices were issued.

4. Mr. Satapathy, learned counsel for the petitioner that he has no up-to-date instruction from the petitioner to pursue the matter at present.

5. Learned Additional Government Advocate referring to the prayer made in the writ petition, i.e., for re-

// 2 // engagement with effect from 06.08.2012 submits that nothing would survive after passage of ten years.

6. Having heard the learned counsel for the parties, the writ petition is disposed of for lack of up-to-date instruction from the petitioner granting liberty to revive the same within sixty days for any surviving cause of action.
