2. The present petitioner has been denied the promotion to the post of Headmaster in Government M.E./U.G.M.E. School against the vacant post of Headmaster occurred prior to 12.08.1997. As the promotion and trained graduate scale of pay have not been provided to the petitioner during his service period, the original application was filed before the Odisha Administrative Tribunal, Cuttack Bench, Cuttack, which has been transferred to this Court.

3. Learned counsel for the petitioner submits that the petitioner has already retired from service and the cause of action does not survive any more.

4. In view of such submission, the WPC (OAPC) is disposed of as infructuous.
