2. The defaulting borrower of Cash Credit facility availed from State Bank of India, which has been declared NPA on 29th March, 2020 with no further action initiated by the Bank, has approached this Court challenging the Demand Notice dated 14.08.2020 (A-1).

3. After hearing the learned counsel for the petitioner and perusing the letter dated 14th August, 2020, we find that the same is not a Demand Notice issued under Section 13(2) of the SARFAESI Act, 2002. Even, if it was so, no application to challenge it would have been

// 2 // maintainable under Section 17 of the SARFAESI Act before the DRT much less writ petition before this Court.

4. In view of the above, the present writ petition is dismissed as not maintainable.
