CORAM:

JUSTICE M.S.SAHOO

ORDER

12.04.2022 Order No.

01.

This matter is taken up through hybrid mode.

The writ petition has been renumbered and registered before this Court on 14.12.2021 after being transferred, upon abolition of State Administrative Tribunal, Cuttack Bench, Cuttack.

On perusal of the available order-sheet of the learned Tribunal, it is found that the matter was never taken-up/pursued after 03.05.2016.

Learned counsel for the petitioner submits that he has no up-to-date instruction to pursue the matter on behalf of the petitioner.

The original application was filed by the petitioner, who was aged about 71 years in the year 2014 claiming duty pay from 01.07.1992 to 30.09.1993 and regularize pay from 01.07.1977 to 24.11.1997 and also sanction of two increments. Learned Additional Government Advocate upon instruction submits that in all probability the petitioner does not want to prosecute the matter as he has been paid his dues as claimed in the writ petition referring to the counter dated 10.03.2016. Having heard the learned counsel for the parties, the writ petition is disposed of due to lack of up-to-date instructions from

// 2 // the petitioner granting liberty to revive the same within sixty days for any surviving cause of action.
