Heard learned counsel for the parties.

The petitioner has filed this writ petition seeking direction to the opposite parties 3 and 4 to declare him as Junior Teacher after completion of three years and Regular Primary School Teacher after completion of 6 years by counting the qualifying period of service from the date of 1st engagement as Sikshya Sahayak, i.e. from 23.11.2003 by taking into account the absent period, i.e. in medical leave period from 01.01.2007 to 29.09.2009 vide Annexure-3 series and 4 as duty period notionally with modification of office Memo No. 1107 dated 03.07.2019 of the Collector, Gajapati vide Annexures-7 and 8.

In course of hearing, learned counsel for the petitioner states that highlighting the grievance, the petitioner has made representation to the opposite party no.3 vide Annexure-9 and direction may be given to consider and dispose of the same, taking into account Annexure-3 series and 4 within a stipulated time, to which learned State Counsel has no objection.

As agreed to by learned counsel for the parties, this Court without expressing any opinion on the merits of the case, disposes of the writ petition directing the opposite party no.3 to take a decision on the representation filed by the petitioner vide Annexure-9, taking into account Annexure-3 series and 4 and pass appropriate order in accordance with law, within a period of three months from the date of production of certified copy of this order by the petitioner. 6.

Issue urgent certified copy as per rules.
