Heard learned Counsel for the parties.

The petitioner has filed this writ petition challenging the action of the opposite parties in taking step for eviction of the petitioner during pendency of the appeal before Opposite Party No.2. 4.

Learned counsel for the petitioner contended that challenging the eviction order passed by the Tahasildar Telkoi-opposite party no.3, the petitioner has filed Appeal Case No. 56 of 2021 before the SubCollector, Champua-opposite party no.2, which is pending consideration before the said authority.

In view of the above, this Court disposes of the writ petition directing opposite party no.2 to dispose of the aforesaid appeal case and pass appropriate order in accordance with law, within a period of three months from the date of production of certified copy of this order by the petitioner.
