IN THE HIGH COURT OF ORISSA AT CUTTACK

WPC (OAC) No. 1741 of 2014 Jamdar Hembram ....

Petitioner Mr. S. Behera, Advocate -versusState of Odisha & others ....

Opp. Parties Mr. N.K. Praharaj, Govt. Advocate (SAT) for O.Ps.1, 2 and 3 None for O.P. 4

CORAM:

JUSTICE M.S. SAHOO Order No.

ORDER

10.11.2022 01.

RJ 1.

This matter is taken up through hybrid mode.

2.

The writ petition has been registered before this Court on 14.12.2021 after the Original Application was transferred from the learned Odisha Administrative Tribunal, Cuttack Bench, Cuttack upon abolition. 3.

On perusal of the available order sheets of the learned Tribunal, it is indicated that notices were issued by the learned Tribunal by order dated 26.04.2014 granting interim order to stay the implementation of the order of transfer (Annexure-3) and directing the petitioner to continue at his earlier place of posting at Karanjia. 4.

Learned counsel for the petitioner fairly submits that considering the nature of grievance raised in the writ petition i.e. challenge to an order of transfer dated 20.06.2014, nothing survives by efflux of time. 5.

Learned Govt. Advocate, SAT referring to the counter filed before the learned Tribunal submits that the transfer

// 2 // being a conditions of service, the O.A. is devoid of merit and is liable to be dismissed.

6.

Having heard learned counsel for the parties, the writ petition is disposed of.
