The Original Application No.3389(C) of 2014 was filed before the State Administrative Tribunal, Cuttack Bench, Cuttack. After its abolition, the same has been transferred to this Court which is renumbered as WPC(OAC) No.3389 of 2014. 3.

The Petitioner while working as constable approached the learned Administrative Tribunal with a grievance that he was not given promotion and challenged the proceeding of DPC dated 04.09.2014 at Annexure-5.

Being directed, counter has been filed on behalf of the Opposite Party No.3.

When the matter is called, Mr. Chandan Sahu, proxy counsel on behalf of Mr. Shashi Bhusan Jena, counsel for the Petitioner submits that he does not have up-to-date instruction.

In view of the above, the writ petition is dismissed with liberty to the Petitioner to revive the same within 90 days from today, if any cause of action still survives. (M.S. Raman) Judge Aks
