1. The matter is taken up through hybrid mode.

2. The petitioner, while continuing as Level-III Teacher (Headmaster) of Jarka U.P.M.E. School in the district of Jajpur, has filed the original application challenging the action of the opposite parties in not giving him promotion as per the gradation list, by counting his service from the date of joining, thereby not providing promotion to the petitioner to the promotional post of Level-II.

3. The grievance of the petitioner is that the juniors have been promoted despite his no adverse remark and or dispute to the basis of the counting service. Hence, the original application has been filed with a prayer for promotion and promotional benefits from the date juniors have been promoted i.e. 08.11.2013.

4. Since the petitioner had filed the original application long back in 2013, which has now been transferred to this Court, by efflux

// 2 // of time, the cause of action might have lost its significance and accordingly, the writ petition is disposed of as infructuous.

5. The petitioner is granted liberty approach the Court afresh, if any cause of action is surviving.
