The Petitioner challenged the order dated 21st October, 2014 issued by the Block Development Officer (BDO), Nuapada (Opposite Party No.3) directing the Petitioner to adjust/refund an amount of Rs.3,33,083/- paid earlier to him as advance to complete developmental work in Nuapada Block.

The impugned order dated 21st October, 2014 indicates that the Petitioner was intimated with regard to outcome of inspection conducted by the Collector, Nuapada (Opposite Party No.2) on 15th October, 2014 wherein, the said Collector has instructed to lodge FIR against the defaulting person/institution concerned who have not adjusted the pending advance lying with them.

3. Mr. N.K. Praharaj, learned Additional Government Advocate has furnished a copy of letter dated 15th November, 2022 passed by the Block Development Officer, Nuapada (Opposite Party No.3), wherein the following has been quoted hereunder:- "To

Submission of relied documents relating to W.P.C (OAC) No.3420 of 2014 (Sahashransu Mishra Vrs. State of Odisha and others ) to drop the proceeding. Ref:

Letter No.5413/G.A. dated 05.11.2014 of the Govt. Advocate, OAT, Cuttack and your office letter No.17495 dated 12.04.2022.

Sir, In inviting a kind reference to the letters and the subject cited above, I am to say that the outstanding advance i.e., Rs.3,33,083/- against the Petitioner has already been adjusted. Further, the Petitioner Sri Mishra has also submitted a written declaration regarding adjustment and clearance of outstanding advances pending against him. In the mean time the Petitioner has already been retired from Govt. Service and "No Dues" certificate has also been issued in his favour. The relied documents are enclosed herewith for kind perusal and the same may please be placed before the Hon'ble Court to drop the proceeding. I would be therefore request you to place the matter before the Hon'ble Court to set right the matter basing on the documents supplied with this letter."
