CORAM:
JUSTICE BISWANATH RATH
ORDER
28.6.2022 Order No.
3.
1.
Heard learned counsel for the Parties.
2.
This Contempt Petition involves non-compliance of the order of the Tribunal passed in O.A. No.777/2012.
3.
In course of argument through the order-sheets, it has been brought to the notice of this Court that similar order of the Tribunal involved was challenged through a Writ Petition and the Writ Petition having been dismissed, State Authority approached the Hon'ble apex Court. There is a clear recording that in the meantime, State's attempt in the Hon'ble apex Court, vide SLP(C) No.40492/2018 filed and the above SLP has been dismissed on 8.4.2022. There is of course neither any Writ Petition nor SLP involving the order at hand. The order of the Tribunal, as it appears, could not be worked out for the State's attempt involving the aforesaid SLP. For the opinion of this Court now that the SLP also
// 2 // has been dismissed, there is no lawful impediment in working out the direction of the Tribunal involving similar direction. 4.
In the process, this Court in disposal of the Contempt Petition directs the Secretary, Health & Family Welfare Department, Govt. of Odisha to work out the direction of the Tribunal issued in O.A. No.777/2012 at last within a period of one and half months from the date of communication of this order by either Party. (Biswanath Rath) Judge M.K.Rout
