Heard learned counsel for the petitioners and learned counsel for the State.

The petitioners are accused in G.R. Case No.79 of 2022, pending in the file of learned Sessions Judge-cum-Special Judge, Malkangiri, arising out of Chitrakonda P.S. Case No.59 of 2022, for commission of alleged offences under Sections 20(b)(ii)(c) of the NDPS Act and is in custody since 10.05.2022. 3.

Being aggrieved by the rejection of their application for bail U/s.439 Cr.P.C. by the learned Sessions Judge-cum-Special Judge, Malkangiri by order dated 16.05.2022 in the aforementioned case, the present BLAPL has been filed.

Learned counsel for the petitioners prays for withdrawal of this bail application with liberty to renew their prayer before the learned Court in seisin, since the consideration before the learned Court in seisin was during the currency of investigation. 5.

Giving such liberty, the BLAPL stands disposed of.

It is needless to say that the petitioners bail application shall be considered on its own merits without being influenced by the earlier rejection or withdrawal of this bail application. (V. NARASINGH) Judge Santoshi
