This matter is taken up through Hybrid Arrangement (Virtual/Physical Mode).

Heard learned counsel for the State. The Petitioner, who appears in person, is not present in Court today. 3.

The present application has been filed by the Petitioner seeking direction to the Opposite Party No.2 to ensure submission of proposal within a time frame to the Govt. in ST & SC Development Department, Odisha, Opposite Party No.1 and to disburse the arrear differential pay as due and admissible along with interest accrued thereon.

On careful examination of the petition and after hearing learned counsel for the State, this Court disposes of the writ petition with a direction to the Block Development Officer, BirmaharajpurOpposite Party No.2 to take immediate action pursuant to letter No.28002/SSD, Bhubaneswar, dated 19.08.2011 written by the Deputy Secretary to Government, ST & SC Development

// 2 // Department, Govt. of Odisha to Opposite Party No.2 within a period of four weeks from the date of communication of this order. In the event, the Petitioner is entitled to pay the TBA scale of pay under the ORSP Rule,1998, he may be paid the same within a period of one month.

A free copy of this order be handed over to Mr.P.C.Das, learned Additional Standing Counsel for the State, who shall intimate the Opposite Party No.2 to examine the issue and execute the direction issued by this Court and communicate the decision to the Petitioner immediately thereafter 6.

With the above observation, the writ petition stands disposed of.
