IN THE HIGH COURT OF ORISSA AT CUTTACK

WPC (OA) No.3500 of 2013 Narottam Behera ....

Petitioner Mr. K. Chandrasahu, Adv.

-versusState of Odisha and others ....

Opposite Parties Mr. G.R. Mohapatra, ASC CORAM: JUSTICE S.K. PANIGRAHI

ORDER

10.03.2022 Order No.

01.

1. The matter is taken up through hybrid mode.

2. None appears for the petitioner.

3. The petitioner challenges the impugned gradation list dated 26.11.2012 issued by the respondent No.1 by which his seniority has been turned down by disturbing his settled seniority vis-à-vis the private respondents by reopening it after 24 years without affording reasonable opportunity of hearing to the petitioner. He seeks to quash the impugned order as he is senior in comparison to private respondents. Hence, the O.A. was filed, which has been transferred to this Court.

4. As reveals from the affidavit filed in the O.A., age of the petitioner was 52 at the time of filing of O.A. Now, due to efflux of time, the petitioner must have attained the age of superannuation. Hence, the grievance as set out in the O.A. seems to have lost its significance.

5. In view of such facts, the present writ petition is disposed of as infructuous.

6. The petitioner is at liberty to approach the Court afresh, if any cause of action survives.

(S.K. Panigrahi) Judge pcd
