Heard learned counsel for the petitioner and learned Addl. Standing Counsel for the State.

The petitioner is in custody since 22.06.2021 in connection with Kasia Marine P.S. Case No.83 of 2021 corresponding to G.R. Case No.507 of 2021 pending in the Court of learned J.M.F.C., Basudebpur for the alleged commission of offence under Sections 498-A/304-B/302/34 of IPC.

The petitioner is the mother-in-law of the deceased. The prosecution case is that the petitioner, her husband and her son subjected the deceased to mental and physical cruelty in connection with their demand for dowry. Though it is alleged that the deceased was subjected to physical cruelty, yet the postmortem report does not suggest any external injury on the body of the deceased. The co-accused persons, who stand on the same footing, namely, father-in-law and husband of the deceased, have been granted bail by this Court as per orders passed by this Court in BLAPL Nos. 9829 of 2021 and 9883 of 2021.

Considering the above facts and the period of detention in custody, I am inclined to allow the prayer for bail. Let the petitioner be released on bail on such terms and conditions as the court in seisin over the matter may deem fit and proper to impose including the condition that she shall personally appear before the trial Court on each date of posting of the case without fail. 6.

BLAPL is accordingly disposed of.
