This matter is taken up through Hybrid Arrangement (virtual/Physical Mode).

Heard learned counsel for the Petitioners as well as learned counsel appearing for the State.

Learned counsel appearing for the Petitioners draws the attention of this Court to a letter issued by the Director, Horticulture, Odisha vide letter No.3/3644 dated 14.03.2016 . In the said letter, recommendation has been made to the Deputy Directors of Horticulture of different districts recommending the names of persons for temporary status and absorption of Casual/Daily Wage Labourers engaged in different Government establishments prior to 12.04.1993 against Group-'D' vacancies. It is further submitted by the learned counsel for the Petitioner that the list annexed to the said letter reveals that the names of the Petitioner Nos.1 and 2 are mentioned against sl.no.68 and 69.

The only grievance of the Petitioners is that despite such

// 2 // recommendations made by the Director, the Deputy Directors of the concerned district have not considered their cases for grant of temporary status.

Mr.P.C.Das, learned counsel for the State submits that as it appears, the matter is pending before the Deputy Director of Horticulture for consideration. He further submits that he will have no objection if direction is given to the Deputy Director, Horticulture to grant temporary status to the Petitioners in the light of letter dated 14.03.2016.

In such view of the matter, the writ application is disposed of with a direction to the Director, Horticulture, Opposite Party No.2 to take a final decision keeping in view the recommendation made by him in the letter dated 14.03.2016 and shall ensure that the concerned Deputy Director, Horticulture take an early decision in the matter as directed by him, preferably within a period of two months from the date of production of certified copy of this order. The decision so taken shall be communicated to the Petitioners within a period of 10 days thereafter.

It is open for the Petitioner to submit any other documents along with a representation and certified copy of this order before Opposite Party No.2. In the event such documents are filed, the Opposite Party No.2 shall consider those documents and pass necessary orders dealing with those documents specifically. 8.

Issue urgent certified copy as per Rules.
