The petitioner was appointed as an Assistant Teacher in Jawahar Academy (High School), in the district of Sonepur against a trained graduate teacher post on 11th July 1969. Subsequently, having acquired B.Ed.

qualification on 5.11.1971, he was kept in charge of Headmaster of the High School with effect from 8.12.1971 and continued as such in that capacity till 4.10.1975. However, on the decision of the Managing Committee of the school, he had to hand over the charge of Headmaster to opposite party No.5 who was stated to be much junior to the petitioner.

After much persuasion, since the Managing Committee did not pay any heed to promote the petitioner to the post of Headmaster in terms of the Odisha Education (Recruitment and Conditions of Service of Teachers and Members of the Staff of Aided Educational Institutions) Rules, 1974, the petitioner has approached this Court by filing a petition which was registered as OJC No.2053 of 1994. The said case was transferred to the Odisha Administrative Tribunal and

// 2 // renumbered as T.A No.9(C) of 2013. Thereafter, the Odisha Administrative Tribunal being abolished, the said case has come back to this Court which is renumbered as WPC(TAC) No.9 of 2013.

Today, when the matter was taken up, Mr. P.N Mohanty, Advocate on behalf of Mr. K.K. Swain, learned counsel for the petitioner submitted that by efflux of time, the matter has been rendered infructuous.

In view of such submission, the writ petition stands disposed of as infructuous.
