The matter is taken up through video conferencing mode. 2.

Heard Mr. A.R. Panda, learned counsel for the Petitioners and Mr. G. Rout, learned Additional Standing Counsel. 3.

This is an application under Section 439 Cr.P.C. for grant of bail to the Petitioners, namely 1) Udhaba Pangi, 2) Jayaram Hantal, 3)Deba Hantal, 4) Bhima Khilla, 5) Shiva Khilla and 6) Dhanurjaya Khilla in connection with Boipariguda P.S. Case No.29 of 2010 corresponding to C.T. Case No.36 of 2021 pending in the court of learned C.J.M.-cum-Assistant Sessions Judge, Jeypore for alleged commission of offence under Sections 147/148/427/324/307/149 of the Indian Penal Code.

It is submitted that the Petitioners are inside custody since 5th August, 2021 and the injuries are simple in nature. 5.

It is submitted by learned state counsel that the case is of the year 2010 and the Petitioners remained absconded till 2021.

However, considering the period of detention of the Petitioners inside custody and the allegations made, it is directed to release the present Petitioners on bail in the aforesaid case on such terms and conditions to be fixed by the learned court in seisin over the matter including the condition that, the Petitioners shall attend the trial court on each date fixed and shall furnish two sureties each out of whom one shall be their relative respectively.

The BLAPL is accordingly disposed of.

As the restrictions due to resurgence of COVID-19 situation are continuing, learned counsel for the parties may utilize a printout of the order available in the High Court's website, at par with certified copy, in the manner prescribed vide Court's Notice No.514 dated 7th January, 2022.
